
An Army Sergeant stationed at Camp Humphreys found himself facing multiple charges after a night out in the “Ville” led to serious allegations. The charges preferred against him at a General Court Martial included attempted sexual assault, abuse and maltreatment of a subordinate, abusive sexual contact, sexual assault, indecent exposure, and assault consummated by battery. The incident began with an evening filled with soju, bar hopping, and pool playing, involving the Sergeant and several other Soldiers, including female Soldiers.
The situation escalated when the Sergeant, having shown interest in female Private, engaged in behavior at a bar that resulted in charges of indecent exposure. An altercation with another Soldier in the bar further complicated matters. The night concluded with the Sergeant and the Private heading to his barracks room, where they hooked up. She later reported that she was too intoxicated to consent, leading to the Sergeant’s arrest by Military Police for the compounded allegations from the night’s events.
Defense attorney Tim Bilecki was retained, focusing on evidence from CCTV across various locations to argue that the interactions between the Sergeant and the E-2 female Soldier were consensual, challenging the basis of the sexual assault allegations. The defense also contended that the altercation was in self-defense.
At trial, the evidence and defense arguments led to the Sergeant’s acquittal on all charges and specifications.
